VOLUSIA EDUCATIONAL SUPPORT ASSOCIATION

CONSTITUTION

2007-2008

ARTICLE I

NAME

This organization shall be known as the Volusia Educational Support Association, and also Local #7468, herein after referred to as the Association. Affiliated with: American Federation of Labor/Congress Industrial Organization, American Federation of Teachers, Central Florida AFL-CIO, Florida Educational Association, and National Educational Association.

ARTICLE II

OBJECTIVES

The purpose of this organization shall be to:

  1. Serve as a leader in protecting the significance of public education and advancing both quality and equality in the public education system.
  2. Fulfill the aspirations and needs of members in order to strengthen the institution of public education by advocating for its members and seek to strengthen and improve the worksites in which they work.

3. Preserve collective bargaining.

4. Promote professional development.

5. Actively recruit and retain members.

6. Support the District Vision Statement.

ARTICLE III

MEMBERSHIP

  1. All employees covered under the Associations bargaining unit shall be eligible for active membership in this organization upon payment of annual dues.
  2. Membership in this organization shall consist primarily of employees of the Volusia County School Board.
  3. Any cash member who becomes thirty (30) days delinquent shall be dropped from the rolls and his/her name removed from the records of the National office. Exceptions may be determined by majority action of the Executive Board.
ARTICLE IV

OFFICERS AND EXECUTIVE BOARD

1. Officers to be elected shall be:

· President

· Executive Vice-President

· Area Vice-Presidents

· Secretary

· Treasurer

  1. All officers shall be elected for 2-year terms with the exception of the Area Vice Presidents who shall serve 1-year terms and may serve as many consecutive years as the membership desires.
  2. All officers shall have been a member of this Association for at least one (1) year prior to the beginning of the term of office.
ARTICLE V

STANDING COMMITTEES

Standing Committees shall be Auditing, Communications, Constitution and Bylaws, Elections, Historian, Hospitality, Membership, Negotiations, Sick Leave Bank, and Ways and Means.

ARTICLE VI

MEETINGS

  1. Association general meetings shall be held at 6:00 p.m. on the third Thursday of September, October, November, December, January, February, March, April and May.
  2. The September general meeting shall be open to all employees of the bargaining unit, with only paid members voting.
  3. Remaining general meetings shall be open to members only.
  4. New officers will begin their term of office July 1.

ARTICLE VII

AMENDMENTS

  1. Any dues-paying member of the Association may propose amendments to the Constitution and Bylaws in writing, no later than May 1.
  2. Proposals will be submitted to the Chair of the Constitution and Bylaws Committee.
  3. The Constitution and Bylaws Committee will present proposed revisions to the Executive Board/Committee at the August board meeting with voting to occur at the September general meeting.
  4. Results of the voting shall be available to the Membership no later than October 31. All changes become effective upon approval.

BYLAWS

2007-2008

ARTICLE I

MEETINGS

All meetings of the Association shall be conducted according to parliamentary procedures as set forth in Roberts Rules of Order, Revised Edition.

ARTICLE II

DUTIES OF OFFICERS

The President is the chief officer of the Volusia Educational Support Association and shall execute faithfully the constitution and bylaws of the organization by:

1. Presiding at all meetings of this Association and of the Executive Board.

2. Calling special meetings.

3. Appointing the Parliamentarian and Committee Chairs.

4. Forming committees.

5. Serving as ex-officio member of all committees except nominating.

6. Representing the local when and where necessary and be spokesperson for the local.

7. Serving as automatic delegate to the FEA, AFT, NEA and AFL-CIO conventions or assemblies.

8. Coordinating with professional staff to bring grievance issues to the Board.

The Executive Vice-President shall:

1. Assist the President in the performance of his/her duties.

2. Report to the President.

3. In the absence of the President shall have all the powers and duties of the President.

4. Act as business agent.

5. See that the business of the Association, necessary for operation, is disposed of in an accurate and timely manner.

6. Coordinate all activities of the committees.

7. Attend all building rep meetings and social events.

8. Perform such duties as designated by the President.

9. Attend all board and general meetings. An explanation of absence shall be given to the President prior to any meeting missed by an officer. Three consecutive absences may result in a request for resignation.

The Area Vice Presidents shall:

1. Represent a geographic area of the County on the Executive Board.

2. Facilitate and communicate the needs and desires of the members in their constituency to the Executive Board.

3. Maintain contact with their constituency.

4. Attend all board and general meetings. An explanation of absence shall be given to the President prior to any meeting missed by an officer. Three consecutive absences may result in a request for resignation.

The Secretary shall:

1. Keep an accurate record of the proceedings of the Association.

2. Conduct the correspondence as directed by the Executive Board/Committee.

3. Submit minutes of each meeting and submit for approval at the next regularly scheduled meeting.

4. Maintain an up-to-date copy of the Constitution, Bylaws, Policies, Roberts Rules of Order and a current membership list.

5. Attend all board and general meetings. An explanation of absence shall be given to the President prior to any meeting missed by an officer. Three consecutive absences may result in a request for resignation.

The Treasurer shall:

1. Keep an accurate record of the monies received and disbursed.

2. Present a report at each regular meeting of the Executive Board and at each general meeting.

3. Submit for annual audit NO LATER than JULY 15.

4. Attend all board and general meetings. An explanation of absence shall be given to the President prior to any meeting missed by an officer. Three consecutive absences may result in a request for resignation.

The Parliamentarian shall:

1. Maintain order.

2. See that meetings are conducted in accordance with the newly revised edition of Roberts Rules of Order.

ARTICLE III

NOMINATIONS

Members desiring to seek candidacy for office must:

  1. Be a member in good standing for at least one year to be eligible for nomination at the March meeting.
  2. Be present at the March meeting to accept or reject the nomination and present them selves to the membership.
  3. At the March meeting the Elections Committee shall present a slate of candidates and the floor will be open for nominations. In the case there is only one nominated candidate for any office, then the election for that office can be held by acclamation vote at the March meeting.

ARTICLE IV

VACATED OFFICES

Where a vacancy occurs in an elected office by resignation, termination or leave of absence, the following

procedures shall apply:

1. More than 90 days prior to the end of the term a special election shall be held.

2. Vacancies occurring within the last 90 days will be filled through appointment by the Executive Board. Office of Treasurer  All records shall be turned over to the Auditing Chair. Office of Secretary - All records shall be turned over to the Executive Board.

ARTICLE V

DUES

1. Dues include membership fees in Local, State and National Associations and may be adjusted annually.

2. Dues may be paid directly to the Association Membership Chair, or by payroll deduction.

3. Dues for active members shall be based on annual salary.

4. Dues for affiliated Associations shall be established as provided for in the governance documents of each organization.

ARTICLE VI

DELEGATES TO CONVENTIONS/CONFERENCES

1. Delegates to the FEA, AFT, NEA or AFL/CIO conventions/conferences must be members of the Association.

2. For Local, State and National: Any member in good standing may submit their name to the Elections Committee for approval.

ARTICLE VII

QUORUM

As defined by Roberts Rules of Order, Revised Edition.

ARTICLE VIII

DUTIES OF COMMITTEES

Auditing Committee shall:

1. Consist of three members; one shall be a member of the Executive Board, for the purpose of auditing the Association books.

2. The Treasurer shall be available to the Auditing Committee, but not a member of the Committee.

3. After completing the audit, the books will be turned over to the Executive Board and a written report given to the Board.

Constitution and Bylaws Committee shall:

1. Be responsible for surveying the membership for proposed changes.

2. Review proposals for legality, compliance and feasibility before revisions are submitted for approval.

Communications Committee shall:

Have charge of all publicity, newsletters, bulletins and meeting notices to be sent to members.

Executive Board shall:

1. Be comprised of the elected officers.

2. Act as an advisory council to the President.

3. Develop the budget for approval at the May meeting.

4. Take action on Association business.

5. Execute the filling of vacancies as in Article IV, Section 1 of the Bylaws. In the event that a duly elected officer fails to perform the duties of the office to which elected, the Executive Board may upon unanimous vote, request resignation of said officer.

6. A majority of the members of the Executive Board present shall constitute a quorum as defined by Roberts Rules of Order, Revised Edition.

Executive Committee shall:

  1. Be comprised of the Executive Board, Committee Chairs, Past President and Parliamentarian
  2. Assist in planning the programs and meetings of the Association.
  3. Perform such other duties assigned to them by the President.
  4. Executive Committee meetings shall be held at the call of the President or by a request of a majority of the Executive Committee members.
  5. Majority of the Executive Committee present shall constitute a quorum as defined by Roberts Rules of Order, Revised Edition.

Historian shall:

Keep a permanent file of the history of all activities of the Association.

Hospitality Committee shall:

1. Under the direction of the Chair, be responsible for setting meeting places.

2. Send flowers and cards in case of death or illness as stated in the Policies.

Membership Committee under the direction of the Chair shall:

1. Encourage all eligible employees to join the Association.

2. Coordinate membership drives.

3. Recruit and train Building Reps.

4. Maintain an up-dated membership and Building Rep. list.

Negotiations Committee shall:

  1. Be responsible for surveying the membership and gathering proposals for bargaining.
  2. Prepare the proposals to take to negotiations.
  3. Elect the Negotiations team.

At the conclusion of negotiations, they shall:

1. Prepare ratification review.

2. Arrange for the ratification vote.

Negotiations Team shall:

  1. Be comprised of the President and six (6) members elected from the committee so that each classification is represented.
  2. Each pay category shall be represented with equal distribution between county level and school level, if possible.
  3. The Chair may act as Chief Negotiator.
  4. The negotiating Team shall be responsible for attending the bargaining sessions and reporting to the Association their findings.

Elections Committee shall:

1. Be alert for the development of leadership.

2. Solicit candidates.

3. Present nominees for all elected officers at the March meeting.

4. Coordinate elections, count ballots and announce the results.
